Seven judge bench to hear BBI Appeal case

The President of the Court of Appeal justice Daniel Musinga has constituted a seven-judge bench to hear the Building Bridges Initiative (BBI) Case.

The hearing of the appeal will take place next week on Tuesday and will be presided by judge Musinga.

The hearing will last for four consecutive days.

The other judges picked include Roselyne Nambuye, Hannah Okwengu, Patrick Kiage, Gatembu Kairu, Fatuma Sichale and Francis Tuyoitt.

The case will start on Tuesday and conclude on Friday.

Afterwards, the bench will depart to write a judgment on whether to maintain the High Court orders which stopped BBI or do away with them.

Meanwhile, a three-judge bench will be constituted to hear the request that was filed by the AG this week, seeking to strike out Lawyer Charles Kanjama’s BBI appeal.

The application will be heard on Monday before the seven-judge bench ahead of their hearing on Tuesday.

This comes a month after a five-judge bench of the High Court ruled that the President does not have authority under the Constitution to initiate changes to the Constitution and that a constitutional amendment can only be initiated by the President through the Attorney General in Parliament through a Parliamentary initiative.
