Uhuru, Raila file a formal petition against the BBI verdict

President Uhuru Kenyatta, ODM leader Raila Odinga, the BBI Secretariat and the Attorney General have formally filed their appeals against the BBI ruling.

The President’s appeal was served yesterday while in Kisumu for the Madaraka day celebrations.

Through Solicitor General Kennedy Ogeto, the AG presented a list of 31 crucial points stating the learned judges slipped up in law and detail by pronouncing the BBI unconstitutional.

President Kenyatta through his lawyer Waweru Gatonye also filed a 10-page formal appeal arguing the same.

The directive as of now sets the stage for the respondents to file their responses before the hearing of the appeal starts.

A three-judge bench is expected to give directions on the appeal today.

On May 14, 2021, the High Court affirmed the Constitution of Kenya Amendment Bill 2020 as unconstitutional.

A lawyer involved in the case, however, states that the focus may shift to the main appeals and not the applications for stay.

The respondents in the case have requested the president of the court of appeal to allocate a seven-judge bench to hear the appeal.
